Welcome to  eSimTel Application (“Application”, “App”, “Service”), operated by Diploy (“we”, “our”, “us”). By downloading, installing, or using this App, you (“User”, “you”, “your”) agree to be bound by the following Terms & Conditions. If you do not agree, please do not use this App.

Welcome to ESimxen (“ESimxen”, “we”, “our”, or “us”). These Terms & Conditions (“Terms”) form a binding agreement between you and ESimxen governing your access to and use of our mobile apps, websites, eSIM marketplace, and related services (collectively, the “Services”). By creating an account, purchasing or activating an eSIM, or otherwise using the Services, you agree to these Terms.

If you do not agree, do not use the Services.

1) Eligibility & Accounts

  • You must be legally capable of entering into a binding contract in your country of residence. If you are using the Services on behalf of a company, you represent you have authority to bind that entity.
  • You agree to provide accurate information and keep it current. We may authenticate your account via email one-time passwords (OTP) or identity providers (e.g., Apple/Google).
  • You are responsible for maintaining the confidentiality of your account and for all activities under it.
  • We may refuse, suspend, or close accounts that violate these Terms, applicable laws, or pose risk.

2) Purchases, eSIM Activation & Refunds

  • Product details. Each eSIM plan is provided by carrier partners and includes its own data allowance, validity, coverage, speed, fair-use, and other constraints presented at checkout.
  • Compatibility. You are responsible for ensuring your device and OS support eSIM and the selected network bands. Device locks or region restrictions may prevent activation.
  • Activation. After purchase, you will receive instructions (e.g., QR code) to install/activate the eSIM. Activation may require an internet connection and may be time-limited.
  • Start of service. Depending on the plan, usage validity can begin on activation or on purchase, as displayed at checkout. Unused data or days typically expire and are non-transferable unless stated otherwise.
  • Refunds. Except where required by law or explicitly stated, purchases are non-refundable once (a) an eSIM profile is delivered; or (b) usage/activation has begun. If a plan cannot be delivered due to our fault, we may provide a replacement or refund at our discretion.
  • Quality & coverage. Network coverage, speed, and latency vary by location, carrier conditions, congestion, device, and local regulations. We do not guarantee uninterrupted or error-free service.

3) Pricing, Taxes & Billing

  • Prices are shown in the currency we display at checkout. We may change prices at any time prior to purchase.
  • Taxes, duties, and fees (e.g., VAT/GST) may apply based on your billing location and are displayed when required.
  • Payments are processed by third-party processors or app stores. By submitting payment information, you authorize charges for the selected products.

4) Subscriptions & Auto-Renewal

  • Some plans may auto-renew. Renewal terms and cancellation methods are shown at purchase (e.g., via Apple App Store/Google Play settings or inside your account).
  • Cancel before the renewal date to avoid being charged for the next period. Partial periods are typically not refunded.

5) Promotions, Credits & Referrals

  • Promotions and referral programs are subject to their specific rules. We may modify, pause, or discontinue them at any time.
  • We may revoke credits or benefits obtained by fraud, abuse, or in violation of program terms.

6) Acceptable Use

  • Do not misuse the Services, including but not limited to:
    • Illegal activities, harassment, or harm to others.
    • Interfering with networks, circumventing technical limits, or reselling service without permission.
    • Using the Services to send spam, conduct fraud, or infringe rights.
  • We may throttle, suspend, or terminate Service for violations or to protect networks and users.

7) Intellectual Property

  • The Services, software, content, logos, and trademarks are owned by ESimxen and its licensors and are protected by law. No licenses are granted except as necessary to use the Services per these Terms.
  • You must not copy, modify, reverse engineer, or create derivative works from the Services except as permitted by law.

8) Third-Party Services

  • We integrate with third-party carriers, processors, app stores, identity providers, and notification services. Their terms and privacy practices govern your use of their features.
  • When you purchase via Apple App Store/Google Play, the respective store terms apply to billing, refunds, and dispute processes.

9) International Use & Compliance

  • You are responsible for compliance with local laws, import/export restrictions, and telecom regulations wherever you use the Services.
  • You represent that you are not subject to sanctions or prohibited export restrictions.

10) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. COVERAGE, SPEED, AND AVAILABILITY MAY VARY.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESimxen AND ITS AFFILIATES, PARTNERS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ESimxen FOR THE SERVICE CAUSING THE CLAIM IN THE 3 MONTHS BEFORE THE EVENT, OR (B) USD 100.

12) Indemnification

You agree to defend, indemnify, and hold harmless ESimxen, its affiliates, and partners from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your use of the Services or violation of these Terms or applicable law.

13) Suspension & Termination

  • We may suspend or terminate your access if you violate these Terms, create risk, or where required by law or partner policies.
  • Upon termination, your right to use the Services ceases, but sections that by nature should survive (e.g., IP, disclaimers, liability limits) will remain in effect.

14) Changes to Services or Terms

  • We may modify or discontinue features at any time. We may update these Terms; changes become effective when posted or otherwise communicated. Continued use after changes indicates acceptance.

15) Communications

  • We may send service messages (e.g., OTPs, critical notices) by email, in-app, or push notifications.
  • Where applicable, you may manage marketing preferences in the app or message footer; service communications are necessary and not subject to opt-out where legally permitted.

16) Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share information.

17) Governing Law & Disputes

These Terms are governed by the laws of [Choose jurisdiction], without regard to conflict-of-laws rules. Any dispute will be resolved exclusively in the courts located in [Choose venue]. Where mandatory consumer protections apply in your country of residence, they remain unaffected.
